Welcome to HRSaathi (the “Platform”), operated by Skysoft IT Services Pvt. Ltd. (“we,” “us,” or “our”), a CMMI Level 3 and ISO 27001:2013 certified company. By accessing or using HRSaathi, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you must refrain from using the Platform.

2. Definitions

  • “Company” refers to Skysoft IT Services Pvt. Ltd., the provider of HRSaathi.
  • “User” refers to any individual or organization using the Platform.
  • “Services” refers to the HR management solutions, including but not limited to employee attendance, leave tracking, payroll management, and reporting.

3. Eligibility

  • You must be 18 years or older to use HRSaathi.
  • By creating an account, you confirm that you have the legal authority to enter into this agreement.
  • You agree to provide accurate, complete, and up-to-date information during registration.

4. Account Registration and Security

  • To access certain features, you must create an account with unique login credentials.
  • You are responsible for maintaining the confidentiality of your account information.
  • The Company reserves the right to suspend or terminate accounts for any unauthorized activity.

5. Services and Usage

  • HRSaathi offers HR management services, including:
    • Employee management (profiles, attendance, leave, and records).
    • Payroll processing and reporting.
    • Communication and team collaboration tools.
  • Admins and HR Managers can access the full suite of management features via the web platform.
  • Employees can apply for leave and mark attendance using the HRSaathi mobile app.

6. Data Privacy and Security

  • We are committed to protecting your data and ensuring compliance with GDPR and other applicable data protection laws.
  • Your personal and business data will be handled securely and used only for service delivery and improvement.

7. Subscription and Payment

  • Subscription Fees: Use of HRSaathi may require a subscription. Payment details will be outlined in the subscription agreement.
  • Renewals and Cancellations: Subscriptions will renew automatically unless canceled before the renewal date.
  • Late Payments: We reserve the right to suspend services for overdue payments.

8. Intellectual Property

  • All content, trademarks, logos, and intellectual property related to HRSaathi are owned by Skysoft IT Services Pvt. Ltd.
  • You are granted a limited, non-exclusive license to use the Platform for business purposes only.
  • Unauthorized copying, distribution, or modification is strictly prohibited.

9. Messaging and Notifications

  • HRSaathi sends WhatsApp, email, and SMS notifications to admins and employees.
  • Notifications may include:
    • User activation links.
    • Attendance, leave, and payroll updates.
    • Reminders and announcements.

10. User Responsibilities

  • When using HRSaathi, you agree not to:

    • Engage in unauthorized access, modification, or disruption of the Platform.
    • Share your login credentials with unauthorized parties.
    • Use the Platform for illegal or harmful activities.
    • Violate data privacy regulations or misuse personal information.

11. Data Protection Standards.

    • As an ISO 27001:2013 certified company, we adhere to strict data protection standards.
    • Users have the right to:
      • Request access, correction, or deletion of personal data.
      • Opt out of marketing communications.
      • Report data privacy concerns.

12. Limitation of Liability

    • Skysoft IT Services Pvt. Ltd. is not liable for:
      • Data loss or unauthorized access due to user negligence.
      • Service interruptions caused by third-party providers.
      • Indirect, incidental, or consequential damages.
    • Our total liability will not exceed the subscription amount paid by the user in the past 12 months.

13. Termination of Services

      • Modify or discontinue the Platform without prior notice.
      • Retain necessary user data for legal compliance after termination.

14. Governing Law and Jurisdiction

      • This agreement is governed by the laws of India.
      • Disputes will be subject to the jurisdiction of courts in Uttar Pradesh, India.
